Terms and conditions

Article 1 – Definitions

Mistress Lounge: the online platform offered by Mistress Lounge.
User: any person who uses the platform.
Creator: a user who offers content via the platform (on this platform also referred to as "Mistress").
Content: all photos, videos, messages, texts and other files.
Creator profile: a profile that is linked to and managed by a real, verified creator, who answers the messages personally or has them answered on their behalf.
Fictional profile: a character on the platform that does not correspond to an existing natural person, even if it has a name, photo and life story. The replies come from a staff member on behalf of the character.

Article 2 – Applicability and provider details

These terms apply to any use of Mistress Lounge.

The platform is offered by:

Trade name: Mistress Lounge
Legal form and Chamber of Commerce (KvK) number: registration with the Dutch Chamber of Commerce has been applied for. Once it is completed, the legal form, the KvK number, the VAT identification number and the business address will be stated here.

Article 3 – Minimum age

The platform is only accessible to persons aged 18 or older. By creating an account, the user declares to be at least 18 years old.

Article 4 – Account

Users are responsible for:

correct details;
keeping their password secret;
all activities via their account.

Every account has a profile page with a display name, avatar, an optional description and online status, visible to other logged-in users (and, if you choose, to visitors). In your account settings you can hide your profile completely from other members, or hide just your photo. Other members can leave public comments under profile photos and on profiles. There are no private messages between members: messages only go between a member and a profile. Contact details, links and phone numbers are not allowed in comments and profile texts; comments may be deleted by the user, the profile owner and staff.

Mistress Lounge may block or delete accounts in case of violation of these terms.

Article 5 – Nature of the profiles and artificial intelligence

Two kinds of profiles exist side by side on Mistress Lounge. For every profile the platform indicates which kind it is.

Creator profiles are managed by a real, verified person. Name, photos and messages may originate from that person. A staff member may also respond on behalf of the creator.
Fictional profiles do not represent an existing person, even if the profile has a name, photo and life story. The replies come from a staff member on behalf of the character.

When creating an account, the user confirms that they understand that not every profile is a real person and that they may therefore be communicating with a character instead of with the person the profile appears to represent.

Artificial intelligence. For profiles where this is enabled, chat messages may be answered automatically using artificial intelligence instead of by a creator or staff member. See the Privacy policy (section 5) for which data this concerns and which service we use for this. Automatically generated text may be incorrect, illogical or inappropriate; here too, replies are entertainment and not advice. If the service we use for this changes materially, we will announce this in advance and update the Privacy policy accordingly.

The platform offers entertainment and roleplay. Replies are not advice of any kind (medical, psychological, legal or financial) and no rights can be derived from them. The absence or failure of a reply does not entitle you to a refund of amounts already paid, except where there is a malfunction on our side as a result of which the message was not delivered at all.

Mistress Lounge is not an intermediary for meetings, prostitution or escort services and does not facilitate contact outside the platform with the profiles or the creators behind them.

Article 6 – Creators

Creators declare that:

they are at least 18 years old;
all uploaded content is lawful;
they own the content or have permission;
they do not pose as another existing person and do not use the name, likeness or content of third parties without right or permission;
they keep the content of conversations with users confidential and do not use, publish or share it outside the platform.

Article 7 – Intellectual property

The creator remains the owner of their content. By posting it, the creator grants Mistress Lounge a non-exclusive licence to make the content available via the platform.

Article 8 – Prohibited content

Not permitted is, among other things:

content involving minors;
illegal content;
violence or criminal acts;
copyright infringement;
spam;
malware;
fraud;
identity fraud.

Mistress Lounge may remove such content immediately.

Article 9 – Payments and subscriptions

Subscriptions, tips and payment requests are processed via recognised payment providers.
All stated prices are in euros and include VAT. A confirmation is sent by email for every purchase.
A subscription runs for the chosen period and is not renewed automatically unless this was expressly stated at the time of purchase. If there is automatic renewal, the user can stop it at any time via their account or via the payment provider; the current period is then completed.
A tip is a voluntary payment by the user to a profile for the chat contact; a payment request is an amount requested by the profile for that same chat interaction. Neither is the purchase of a product, but a payment for a service that is already under way or has been completed at the time of payment.
Subject to the right of withdrawal in article 10 and subject to malfunctions on our side, payments are final.

Article 10 – Right of withdrawal for digital content and services

A consumer has, in principle, a fourteen-day cooling-off period for a distance contract. Two situations apply on the platform, each with its own statutory exception.

Subscriptions are digital content that is delivered immediately after purchase. When completing the purchase, the user must first expressly consent to immediate delivery — only then can the payment be completed — and thereby acknowledges that they lose their right of withdrawal as soon as delivery has been completed (article 6:230p under g of the Dutch Civil Code). For a subscription this means: at the moment the subscription has been activated.

Tips and payment requests are not digital content but a payment for a service (the chat contact with the profile) that is already under way or has been completed at the time of payment. Here too, the user must first expressly consent to immediate performance — only then can the payment be completed — and thereby acknowledges that they lose their right of withdrawal as soon as the service has been fully performed (article 6:230p under d of the Dutch Civil Code). For a tip or payment request this means: at the moment the payment has succeeded.

If in either of these cases the payment has not been delivered/performed, the user can dissolve the contract without giving reasons within fourteen days after purchase by sending a message to info@mistresslounge.nl. We will then refund within fourteen days via the same means of payment.

Article 11 – Payouts to creators

Creators receive payouts in accordance with the conditions stated on the platform. Mistress Lounge may temporarily suspend payouts in case of suspected fraud or violation of these terms.

Article 12 – Taxes

Creators are themselves responsible for filing taxes and social security contributions.

Article 13 – Availability

Mistress Lounge strives for maximum availability but gives no guarantee of uninterrupted service.

Article 14 – Privacy

Personal data is processed in accordance with the Privacy policy.

Article 15 – Notifications

The user can enable push notifications per device to receive an alert for a new chat or a new message. Notifications are optional and are only sent after express permission in the browser. Delivery runs via the push service of the browser vendor; the notification text never contains the content of a conversation. The user can switch notifications off again at any time, after which the associated subscription is deleted. See the Privacy policy for the details.

Article 16 – Liability

Mistress Lounge is not liable for indirect damage, loss of profit or consequential damage, except where the law provides otherwise.

Article 17 – Termination

Mistress Lounge may terminate accounts in case of:

fraud;
abuse;
violation of these terms;
legal obligations.

Article 18 – Amendments

Mistress Lounge may amend these terms. New terms are published on the website.

Article 19 – Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent Dutch court.
